Personal data processing principles

In this document we would like to inform you of all important information concerning the processing of personal data in the operation of the raaltrans.com and raal.cz and raal.sk websites (hereinafter referred to as the websites).

The operator of the websites and the controller and processor of personal data is the service provider – RAALTRANS a.s., ID No.: 03192041, Jana Černého 545/48, Hradec Králové – Věkoše, 503 41, CZ.

RAALTRANS a.s. takes a responsible approach to the processing of personal data and takes particular care to ensure its security, all in accordance with generally binding legal regulations. When processing personal data, it is governed by the applicable legal regulations, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC General Data Protection Regulation (hereinafter referred to as GDPR) and Act No. 110/2019 Coll. on the processing of personal data.

In all matters related to the processing of personal data, you can always contact RAALTRANS a.s. directly, which is the controller of the personal data it processes in connection with its business. The operator processes only the strictly necessary basic data, namely identification data (name and surname, IP address, residential or registered office address, possibly also delivery address, registration number, VAT number) and contact data, i.e. your e-mail and telephone number. It also processes data about the purchase you have made or the services you have provided, including any communication, in particular if it concerns a complaint, return of goods or the exercise of your rights.

The operator processes personal data for the purpose of providing you with its services. In order for you to enter into a contract, i.e. to use the services of the contact database, the provider necessarily needs to know your identification and contact details. For this purpose, the provider does not need your consent to the processing of this personal data; the lawful reason in this case is the performance of the contract (and, where applicable, the taking of pre-contractual measures). The provider also processes your personal data for the purpose of further performance of the services provided by us.

The provider also processes personal data for marketing purposes: If you wish to receive commercial communications (“newsletters”), the provider will process your personal data for the purpose of sending newsletters. Newsletters will be sent to the email address or phone number you provide; either as part of the order process or in the newsletter subscription. You can cancel the sending of commercial communications at any time.

For the purpose of improving our service or in case of future disputes, the provider is entitled to record telephone calls or keep records of online chat within our customer service centre. These recordings are kept for six months and then destroyed. Online chat communications are also retained for the same period.

The Provider is entitled to process your personal data in order to protect our rights and legitimate interests, typically in the event of any dispute. Therefore, in this case, it does not need your consent to process your personal data. The processing of some personal data is directly required by law, e.g. the provider is obliged to keep tax documents for a legally specified period of time.

The website uses cookies for its activities, i.e. we process your cookies, including persistent cookies. Cookies are short text files generated by a web server and stored on your computer via your browser. Cookies allow the website to record information about your visit, such as your chosen language and so on, so that your next visit to the website can be easier and more enjoyable. Cookies are important because without them, browsing the internet would be much more difficult.

Within your browser settings, you can manually delete, block or completely disable the use of individual cookies. For more information, please use your browser help. If you do not allow the use of cookies, some functions and pages may not work as they should.

We use cookies to personalise content and ads, provide social media features and analyse our traffic. The provider shares information about how you use our website with its social media and analytics partners. By using the website, you consent to the linking of our services: Google, etc.

In order to display targeted advertising within advertising and social networks on other websites, the provider transmits data about your behaviour on the website to these advertising and social networks; however, it does not transmit your identification data to them.

The provider carefully considers and assesses whether the transfer of personal data to another recipient is necessary and, in particular, whether the potential recipient is able to ensure adequate protection of the personal data transferred. The transfer of personal data takes place exclusively on the basis of a written contract for the processing of personal data. Specifically, personal data is transferred:

  • to payment service providers and payment processors for the purpose of securing the transfer of funds;
  • providers of service, postal and transport services;
  • certain personal data may be transferred to the competent public authorities upon request.

The recipients of the data are not authorised to process the data for any other purpose or to transmit the data to any other person without the consent or instruction of the provider, unless they have a lawful reason to do so.

Your personal data will not be transferred by the provider to a country outside the European Union (or outside the EEA countries, i.e. the European Economic Area) where a sufficient standard of protection of personal data would not be ensured. Nor does the provider intend to transfer personal data outside the European Union.

You can contact us at any time to request details of the processing of your personal data and the Provider will provide you with details free of charge or provide you with a copy of the data processed. This isyour right to access your personal data. However, the provider warns that in the event of repeated or unjustified requests, it is entitled to demand payment of the costs involved in providing the information or to refuse to provide the information.

You have the right to rectification of your personal data, i.e. you may contact the provider to request rectification if the data held about you by the provider is inaccurate, incomplete or out of date. You have the right to erasure of personal data, i.e. you can contact the provider to request that your personal data processed by the provider be erased. The provider will delete your personal data if the data is no longer necessary for the purpose for which it was processed,

  • if you have withdrawn your consent to the processing of the data,
  • the data has been processed unlawfully,
  • the data must be erased to comply with a legal obligation, or
  • the data was collected in connection with the offer of information society services.

You have the right to restrict the processing of your personal data, i.e. you can ask the provider to restrict the processing of your personal data. The provider will restrict the processing of your personal data if:

  • you contest the accuracy of your personal data,
  • the processing is unlawful but you refuse to erase such personal data,
  • you request the processing of personal data for the purpose of pursuing your claims, even though
  • the purpose for which the provider processed the data has already been fulfilled; or
  • you have objected to the processing and it has not yet been verified that the legitimate interests of the provider outweigh your legitimate interests.

You have the right to transfer your personal data, i.e. you can ask the provider to provide your personal data in a structured, commonly used and machine-readable format or to transfer it directly to another controller. The transfer can only take place if the processing is based on a contract or your consent and is also automated processing.

You have the right to withdraw your consent to the processing of your personal data at any time.

You have the right to object to the processing of personal data, in particular if:

  • the provider carries out the processing of personal data on the basis of its legitimate interest. In this case, your personal data will no longer be processed unless the provider demonstrates to you that its legitimate interest takes precedence over your interests.
  • your personal data is processed by the provider for direct marketing purposes. In this case, your personal data will no longer be processed.
 

The duration of the processing of personal data is determined by the specific purpose of the processing in this document. The period for which the provider will process your personal data is determined by the obligations arising from the contract you have entered into and other obligations imposed by law, such as the obligation to archive statutory documents. In some cases, the duration of the processing of personal data depends on the duration of your consent to the processing. In any case, we destroy data that is not necessary for the fulfilment of the purpose or for which we have no lawful basis for processing.

If you wish to exercise any of your rights, you can make a request in the following way:

(a) in writing, by sending the request to the provider’s registered office,

b) by email to gdpr@raal.cz with a valid electronic signature, without this proof of identity it cannot be accepted.

c) via the provider’s data box.

Please indicate in it:

1) Identification data – name, surname, date of birth

2) What right you are requesting to exercise

3) Clarification of the request – e.g. in case of correction of correct data

4) Telephone number – for any clarifications and to arrange further action

If there is any doubt about your identity, we are entitled to ask you to provide additional information to confirm your identity.

In the event that this Privacy Policy is issued in a bilingual version, the version issued in the Czech language shall prevail.

If you believe that the provider is processing your data in an unlawful manner, you have the right to lodge a complaint with the supervisory authority, which is the Office for Personal Data Protection.
